Terms of Service

These Terms of Service apply to all contracts between Lennart Rabe Einzelunternehmen Dantestraße 1 80637 München (hereinafter "Provider") and the customer (hereinafter "User") regarding the use of the PV VisionGen platform (hereinafter "Service"). Deviating terms and conditions of the User are not recognized unless the Provider expressly agrees to their validity in writing.

The Provider provides a web-based platform that uses artificial intelligence to create photorealistic visualizations of photovoltaic systems. The User uploads a photo, and the AI pipeline generates a visualization with embedded PV modules. The Provider owes the provision of the service, but not a specific result of the AI generation. The generated visualizations are AI-created representations and do not constitute technical planning, feasibility studies, or binding commitments regarding the actual feasibility of a PV system.

Registration is required to use paid features. The User is obliged to provide truthful information and to keep their access data confidential. The free demo only requires an email address. Demo usage is limited to one visualization per email address per day.

Current prices are available on the website under "Pricing". All prices include statutory VAT. Both one-time purchase packages (pay-per-use) and subscriptions (monthly) are offered. The Provider reserves the right to change prices. Price changes do not apply to already booked and paid services. For subscriptions, price changes take effect with 30 days' notice at the next billing period.

Payment is processed through the payment service provider Stripe. Payment methods supported by Stripe are accepted. For one-time packages, the payment amount is due immediately upon booking. Purchased credits are valid for 6 or 12 months depending on the plan. For subscriptions, billing occurs monthly. Credits are added at the beginning of each billing period. Unused credits from a month expire at the end of the respective billing period and are not carried over. Subscriptions can be cancelled monthly. Cancellation takes effect at the end of the current billing period. Remaining credits after cancellation can be used until the end of the paid period. In case of payment default, the Provider is entitled to block access to the Service.

The User receives a simple, non-transferable right of use for the generated visualizations for business and private purposes. The User agrees to: - Not upload images that violate applicable law - Not upload images to which they do not hold the rights - Not misuse the Service (e.g., automated mass requests) - Not present generated visualizations as real photographs

The platform, software, and PV VisionGen brand are the intellectual property of the Provider. Images uploaded by the User remain the property of the User. The Provider receives a time-limited right of use exclusively for the purpose of providing the service. Upon full payment, the User receives a simple right of use for the generated visualizations.

The Provider is liable without limitation for intent and gross negligence. In case of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations), limited to foreseeable, contract-typical damage. The Provider is not liable for: - The technical correctness or feasibility of the depicted PV systems - Damages resulting from incorrect or misleading AI generations - Outages or limitations due to third-party APIs (Google, Anthropic) - Data loss, insofar as the User has failed to perform reasonable data backup

Consumers have the right to withdraw from this contract within fourteen days without giving reasons. The right of withdrawal expires prematurely for digital content if the Provider has begun to execute the contract after the User has expressly consented and simultaneously confirmed their knowledge that they lose their right of withdrawal. For visualizations already performed (pay-per-use), withdrawal after delivery of the result is excluded, provided the User has consented to early commencement. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The place of jurisdiction for all disputes arising from or in connection with these Terms is, to the extent permitted by law, the registered office of the Provider.
